This document by its contents makes available to third party users the Regulations for terms and conditions of use of website www.ovep-neha.com. The use of website (including access, surfing and purchase of products from this website) represents a default consent to observe the terms and conditions listed in this document with all the effects and consequences resulting from it.

The administrator of the website www.ovep-neha.com reserves the right to change at any time the contents of this agreement, without the prior notification of the persons who use it, hereinafter referred to as Users. The Users will have permanent access to the terms and conditions of use of services, to consult them at any time.  

Contents of website and intellectual property rights  

The contents of this website cannot be used, reproduced, distributed, transmitted, exposed for other purposes than those expressly and legally permitted. The extraction of any information followed by any use for commercial purposes which exceeds the scope of the private copy regulated by the law or for sale or licensing and without having first a written consent of the holders of intellectual property rights represents a violation of the terms and conditions.  

You also agree not to affect and interfere in any way with the security elements of the website, with the elements which prevent or restrict the use, copying of a content or elements which reinforce the limits of using the website or its contents.  

The right of consumers for unilateral denouncement of the contract  

The consumer has the right to notify in writing the trader that he/she waives the purchase, without penalties and without invoking a reason, within 30 calendar days from the reception of the product or in case of provision of services, from the conclusion of the contract.   

Fraud

For the purpose of accessing and using certain sections of the website, the creation of a personal account may be necessary. You hereby declare that you take fully the responsibility for all and any activities carried out through the account you open on the website and therefore, we advise you to assure the security of account password or other access data. If the security of account you have is compromised, you have to announce immediately the administrator of website. www.ovep-neha.com is not responsible for the damages caused to you or which are caused to third parties of any kind by the unauthorized use of account.  

Applicable law

By using the website www.ovep-neha.com the User declares that he/she agrees that the Romanian laws will govern the Terms and Conditions of use and any dispute of any kind which may appear between the users and administrators of www.ovep-neha.com or its associates/partners/affiliates.  In case of potential conflicts, we will try first to amicably settle them and if the amicable settlement of disputes is not possible, the conflict will be settled by the competent court of law from the office of website administrator, according to the Romanian laws in force.

Guarantees

Our products do NOT have guarantee, because they are consumable products.  

We guarantee that the products sold by www.ovep-neha.com are original products.   

The guarantee of conformity is the guarantee offered by the Seller, according to the laws in force and refers to the period of time between 6 months and 2 years in which the Seller guarantees that the sold product is compliant with the specifications he committed to sell. This guarantee is independent from the technical/commercial guarantee, which may be smaller, larger or equal and does not make the object of technical deficiencies.  

The period of time established for the remedy of repair is maximum 15 calendar days from the date when the buyer informed the Seller about the lack of conformity of the product.   

Security of personal data

www.ovep-neha.com commits not to transmit the personal data of the website users to third parties, and to use them only for the purpose of establishing contact with its customers, and for the purpose of informing them about the aspects related to the functioning of website and its offers.  

The personal data introduced by the buyer can be used by www.ovep-neha.com, only for the declared purpose of this website.  

The information from the order form is necessary to send you the confirmation of orders, for the delivery of ordered products, the announcement of ongoing promotions etc., in any case, it will not be provided to third parties.  

www.ovep-neha.com does not sell, does not offer, does not exchange email addresses obtained through this website, does not disclose your email address to other persons who have access to the pages of this website, without your explicit consent.  

According to the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 for the protection of individuals regarding the processing of personal data and free movement of these data, the Law no. 129/2018 and the Law no. 506/2004 for processing personal data and protection of private life in the sector of electronic communications, www.ovep-neha.com has the obligation to administer in safe conditions and only for the specified purposes, the personal data you provide about you, a member of your family or another person. The purpose of data collection is: takeover, invoicing and delivery of online orders and transmission of promotional materials, personalized messages, information about new products, newsletter, etc.. By exception, your personal data will be transmitted to the specialized courier companies for the purpose of delivering the ordered products.  

You are obliged to provide the data, which are necessary for invoicing and delivery. Your refusal may determine the non-execution of the order.  

The information recorded is designed for its use by the Controller.  

According to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 for the protection of individuals regarding the processing of personal data and free movement of these data, you have the right of access, the right of intervention on data, the right not to be subjected to an individual decision and the right to address the court. You also have the right to oppose to the processing of personal data about your own person and to request the erasure of data. For the exercise of these rights, you can make a written request, dated and signed, to info@ovep-neha.com.

You are also recognized the right to address the court of law.  

If any of your data about yourself are incorrect, please inform us as soon as possible.  

Any use who explicitly provided his/her email address on the website www.ovep-neha.com can opt for its deletion from our database. In every newsletter you have the opportunity to unsubscribe.  

Return of products

According to GEO no. 34/2014, the consumer has the right to withdraw from the remote contract, by notifying in writing, by e-mail , to the address: info@ovep-neha.com that he/she waives the purchase, without penalties and without invoking a reason, within 30 calendar days from the reception of the product. The waiver of purchase shall apply only to customers who are natural persons (art. 2 paragraph 1).

The following products are exempted from the right to withdraw from the contract:

1. the supply of products which are susceptible of deterioration or fast expiry (art. 16, let. d);
2. the supply of sealed products which cannot be returned for reasons of health protection or hygiene reasons and which were unsealed by the consumer (article 16, let. e);

Thus, the cosmetics and hygiene products returned must be in the same condition in which they were delivered, in original packaging (including the protective sheet or seal, if they exist), with all related accessories, without presenting signs of wear, change or consumption, both for the products and accessories (boxes, supplementary packaging), with intact labels and all the original documents which accompanied them (e.g.: user instructions).

The return of products is at the expense of the customer, without unjustified delay and within maximum 14 calendar days from the date when he/she communicated the professional his/her decision to withdraw from the contract according to art. 11. The deadline is respected if the products are sent back by the consumer before the expiry of the period of 14 calendar days (art.14, paragraph 1).

At reception, the parcel will be checked to see whether it complies with the conditions mentioned above, otherwise it will be refused. Thus, we will refuse the parcels which contain products in another status than the status in which they were delivered, whose return was not previously notified, and those which contain deteriorated products during transport as a result of inadequate packing.  

According to the law, www.ovep-neha.com will return the countervalue of returned products (excluding the transport fees) within maximum 14 calendar days from the denouncement date, by bank transfer in the bank account specified by the customer for the orders which had payment at delivery or by bank transfer bancar and for the orders paid by card, the amount will be returned on the same card used for trading, within maximum 30 days from the acceptance of return.  

Delivery 

We are not responsible for the delay of delivery of orders caused by external factors: extreme weather conditions, car accidents, strikes, natural disasters, street manifestations or other special situations which may prevent the fast courier companies from delivering within 24 – 72 hours, for which www.ovep-neha.com will not pay compensations for the prejudices created by the non-delivery on time of the products.  

The products will be delivered by fast courier service.  

Delivery deadline

The orders will arrive at you within 1-3 working days*. When we dispatch a parcel, you will receive an automatic notification by e-mail. 

*The deadline of 1-3 working days is valid for the products that are on stock when the order is processed and is guaranteed only to the extent of contractual obligations undertaken by the courier company. The deadline elapses from the moment of confirming the dispatch of order. For the hardly accessible towns, which are outside of the ordinary area of delivery of couriers, the delivery deadline can extend in some cases by 24h-48h. during promotions the delivery deadline can extend to 5-7 working days.

Transport is made by fast courier services and the transport fees and gratuities are valid only in the coverage area of courier companies.  

*For the customers who return products, the transport costs for the return of products will be covered by you.  

How is payment made?

• CASH ON DELIVERY (upon reception of products)

The total parcel price will be paid to the fast courier agent, when you receive the products.  

• OP (Banker‘s draft)

After the validation of order by phone or email, you can make the payment into the bank account you will receive by email when you finalized the order.  

• Credit/debit card – Online Payments processor (www.plationline.ro)

1. The cards accepted are Mastercard / Maestro, Visa and Visa Electron – any model. The payment is made in maximum security conditions, without charging any additional commission.  
2. After the finalization of order, you will be redirected automatically to a secured link where you have to follow the instructions received. When you finalized payment, both we and you will receive a notification on email address (the lack of this notification from Netopia Payments shows that the transaction was not successfully finalized).
3. Processing card data will be made exclusively on the server of Netopia Payments, www.ovep-neha.com does not request and does not store any details about your card.  

Deterioration of parcels during transport  

In spite of correct and rigorous packing which may prevent incidents during handling and delivery of parcels, there may appear situations when the integrity of parcels is affected.  

Prices

Our price policy involves correct and long-term stable prices. All the prices of products on this website are expressed in RON and include taxes. The prices do not include the transport fees. The transport fees are calculated by the system and will be displayed at the finalization of order. The supplementary weight fees for the parcels which exceed 1 kg will be calculated after the packing and weighing of parcels and will be communicated to customers in writing or by phone.  

Promotions, price discounts

All the promotions present on website are valid within the limits of available stock or at intervals specified punctually.  

Service availability

The administrator of website www.ovep-neha.com reserves the right to change the structure and interface of any page or sub-page of the website www.ovep-neha.com at any time and at any period of time freely chosen, has the right to temporarily or permanently, partially or totally interrupt the services made available to the public on this website without any prior individual or general notification.

The pictures are offered on website with title of presentation and the delivered products may differ from pictures – due to the change of design, packaging, change of brand image.  

Disputes 

Any dispute which appeared between the Customers and www.ovep-neha.com will be amicably settled. If the amicable settlement of dispute was not successful, the competence reverts to the court of law from the office of website administrator.  

Final provisions

NATURAL VIBRATIONAL ENERGY SRL reserves the right to make any changes to these provisions and any changes to the website www.ovep-neha.com, its structure or any changes which may affect the website without any previous notification to users in this respect.   

Electronic invoice

After reading the terms and conditions, you agree to the issue of invoice for the order exclusively in electronic format, and the electronic invoice will be delivered to the email address from the order or in your account.
